Jerome Gallagher engages in civil trial and appellate practice with a concentration in commercial litigation, creditors’ rights, construction, contract litigation, and commercial accounts receivable matters.  Jerry also regularly represents clients in drafting and negotiating commercial and industrial products and services agreements.

Jerry serves as New Jersey counsel to several national companies, including Intercos Europe, SpA; IPFS Corporation; Jansy Packaging, LLC; and Valley National Bank, N.A. Jerry also represents several private businesses in industries, including banking/financial services, cosmetics, retail packaging, computer support, and specialty concrete products.

Jerry has achieved several significant results for clients, including: an appellate affirmance of a trial court’s dismissal of “spoliation of evidence” claims against a national financing company; a jury verdict dismissing claims against a national real estate developer for alleged violations of New Jersey’s Consumer Fraud Act; prosecuting fraud claims against an insurance broker on behalf of a premium finance company, resulting in a seven-figure money judgment; a jury verdict dismissing “lender liability” claims; dismissal of Consumer Fraud Act and punitive damages claims brought against a privately owned electronic parts testing company; domesticating foreign judgments; recovering payments on surety bonds; obtaining numerous monetary judgments in favor of financial institutions and businesses on commercial loan and accounts receivable claims; and regularly represents contractors in residential and commercial construction disputes, lien claims and commercial collection actions.

Jerry is also a leader in civic and community service organizations.  Since 2020, he has served as Chair of the NCE Board of Visitors at the New Jersey Institute of Technology, and previously served as Chair of  NJIT’s Civil and Environmental Engineering Industrial Advisory Board, of which he has been a member since 1999.  For the past 10 years, he also serves as a Trustee of the Passaic Optimist Foundation and chairs its annual fundraiser golf outing.

Recent Decisions

  • Received a decision from the Appellate Division reversing a trial court’s dismissal of a real estate developer’s claim for violations of 42 U.S.C. § 1983 based on the “continuing violations” exception to the two year statute of limitations applicable to such claims and remanding the matter for trial.
  • Recovered a $588,618 Non-dischargeability Judgment from the United States Bankruptcy Court in favor of a bank and against the principal of a title agency who participated in a conspiracy to defraud the lender.
  • Recovered a $915,968 Non-Dischargeability Judgment from the United States Bankruptcy Court in favor of a premium finance company and against an insurance broker who fraudulently converted the financing proceeds.
  • Obtained an affirmance from the Appellate Division of a Chancery Court decision following a bench trial awarding a real estate developer a $508,000 Judgment for pre-construction development expenditures in a failed real estate joint venture, piercing the corporate veil to impose personal liability on the joint venturer, and granting a recordable equitable mortgage on the real property to secure repayment.
  • Successfully defended an appeal from a jury verdict entered in favor of a client, and recovered payment in full against a surety bond posted to stay post-judgment collection proceedings pending appeal.
  • Obtained summary judgment dismissing claims asserted under the New Jersey Consumer Fraud Act against an electronic parts testing company.
  • Domesticated Oregon Judgment in New Jersey, successfully opposed debtor’s objections on jurisdictional grounds, successfully defended against the Debtor’s appeal, and recovered payment in full from a surety bond posted to secure the Judgment and stay execution proceedings.
